About the Role
To conduct inspections, investigations, and initiate enforcement in accordance with the City of Toronto Municipal Code and related provincial statutes, to inform members of the public of their responsibilities and to promote compliance with the City's bylaws and other provincial statutes.
Responsibilities
- Carries out legislated and legal requirements as a Provincial Offences Officer and/or Municipal Law Enforcement Officer.
- Interprets and applies a broad range of City of Toronto Municipal Code chapters, City bylaws, and provincial statutes.
- Conducts proactive and reactive inspections and investigations of properties and vehicles.
- Ensures compliance with the City of Toronto Municipal Code regarding fences, property maintenance, graffiti, noise, waste collection, litter, dumping, adequate heat, abandoned appliances, and vital services.
- Conducts inspections and investigations of licensed businesses and permit holders for compliance.
- Investigates complaints related to zoning matters, pursuant to the Planning Act.
- Conducts research using various databases and the Internet.
- Installs, maintains, and calibrates field monitoring instrumentation.
- Initiates and conducts joint inspections and/or investigations with other organizations.
- Prepares and issues Orders and Emergency Orders under the Ontario Building Code Act and the City of Toronto Municipal Code and bylaws.
- Enforces court orders, closure orders, and prohibition orders.
- Obtains and assesses professional engineer's reports and issues appropriate Orders.
- Maintains City records in data management systems and ensures confidentiality.
- Issues Notices of Violation, Orders, and initiates Part I and Part III processes of the Provincial Offences Act.
- Employs investigative techniques to gather and analyze evidence.
- Develops and implements investigative plans, including conducting interviews and surveillance.
- Seizes, collects, documents, and stores evidence.
- Monitors remedial work of contractors to ensure compliance with contractual terms.
- Provides written confirmation of work performed.
- Seizes vehicles, equipment, signs, merchandise, goods, waste, and other contravening items.
- Coordinates the recording, storage, and release of seizures.
- Arranges for removal of encumbrances and debris.
- Initiates remedial action to address emergency conditions.
- Prepares correspondence and reports for management, Committees, Licensing Tribunal, and briefs for prosecution.
- Reviews case files with prosecutors and makes recommendations on fines/penalties.
- Attends court and other quasi-judicial bodies to provide evidence.
- Swears information before the Justice of the Peace and serves summons.
- Determines and executes appropriate enforcement and/or educational strategies.
- Communicates orally and in writing with various stakeholders.
- Applies a customer service approach and utilizes alternate dispute resolution and mediation.
- Represents the Municipal Licensing and Standards Division at various meetings.
- Interacts with the public, law enforcement agencies, property owners, tenants, solicitors, and government officials.
- Participates in the review of existing and development of new programs and processes.
- Ensures compliance with health and safety procedures and use of issued equipment.
- Conducts educational programs and trains new officers and students.
- Distributes work to the administrative team.
Requirements
- Post-secondary education in a related discipline such as law enforcement, MLEO Certification and/or criminology, or an equivalent combination of education and relevant work experience.
- Considerable experience in an enforcement or regulatory compliance environment.
- Ability to interpret and apply complex by-laws and legislation.
- Considerable experience conducting enforcement investigations, including advanced field inspection techniques, formal interviews, and enforcement actions.
- Considerable experience resolving conflicts with the public through formal or informal dispute resolution methods.
- Experience conducting research and analysis, developing case files, recording information, and preparing reports.
- Ability to deliver testimony in a court or tribunal setting.
- Must possess and maintain a valid Ontario Class ‘G’ Driver’s Licence.
- Must maintain the City’s operating permits and requirements.
- Ability to work rotating shifts (day, afternoon, night, weekend and holidays) independently.
- Ability to work in an outdoor environment which can include extreme weather conditions.
- Ability to lift objects weighing up to 20 kgs into the box of a pick-up truck.
- Excellent and effective verbal and written communication skills.
- Ability to be tactful, patient, and courteous when dealing with the public, elected officials, and staff.
- Ability to utilize a variety of software applications such as Microsoft Office and case management systems.
- Ability to write in a clear, concise, and legible manner.
- Ability to work independently and be proactive while functioning within a robust team environment.
- Excellent analytical, problem solving, and decision-making skills.
- Ability to apply analytical, problem solving, and decision-making skills when assessing difficult and challenging situations.
- Ability to organize field work, exercise initiative, discretion, and independent judgment.
- Thorough knowledge and understanding of the by-laws and legislative requirements relating to the division’s core functions.
- Ability to present evidence in court or other discovery proceedings.
- Must have access to a personal vehicle that is properly maintained and insured.
- Ability to read and interpret related documents, e.g. engineering plans, architectural and landscape drawings and legal documents would be an asset.
- Knowledge or understanding of the maintenance and operation of building components such as building envelop, mechanical, plumbing, and electrical systems would be an asset.
- Completion of the Ontario Association of Property Standards Officers (OAPSO) Part 1 or Municipal Law Enforcement Officers Association (MLEOA) Part 1 foundations course is considered an asset.
- Previous designation as a Provincial Offence Officer would be considered an asset.
- The ability to speak multiple languages to support the diverse culture of the City of Toronto would be an asset.
- As a condition of employment, all successful internal and external candidates must provide a current Criminal Police Reference Check issued within three (3) months of the anticipated start date.
