About the Role

Anthony Gold is seeking an experienced and motivated Court of Protection Solicitor to join their London-based team. This role involves advising and representing clients, often vulnerable adults, in complex legal matters related to the Court of Protection, Mental Capacity Act 2005, and associated areas. The position offers the opportunity to work on significant cases, often involving multi-million-pound awards and sensitive family dynamics, requiring strong analytical, financial, and interpersonal skills.

Responsibilities

Advise clients, families, and carers on mental capacity and Court of Protection processes.
Make applications to the Court of Protection for deputy appointments, statutory wills, and complex financial or health decisions.
Act as a professional deputy or support lay deputies in managing client property and affairs.
Manage Property and Affairs Deputyships, work with brain-injured and vulnerable clients, and handle Trust management.
Assist with tax affairs and accounts, draft Personal Injury Trusts, Statutory Wills, and Welfare Deputyship applications.
Handle Court of Protection disputes, including capacity challenges and disagreements about deputyship or decisions.
Prepare and review Lasting Powers of Attorney and advise on their use and registration.
Liaise with healthcare professionals, social services, and other stakeholders to gather evidence and ensure client best interests.
Provide training and updates to clients and colleagues on Court of Protection law and practice.
Maintain accurate records and comply with SRA standards.
Handle complex property or family disputes requiring urgent intervention and support.

Requirements

Qualified solicitor in England and Wales.
At least 2-5 years of post-qualification experience (PQE) in court of protection matters.
Excellent knowledge of the law relating to the role.
Sound understanding of the Mental Capacity Act 2005 and associated codes of practice.
Ability to work independently and manage a caseload efficiently.
Outstanding communication and client care skills, with a sensitive approach to complex family dynamics.
Proactive, organised, and capable of working under pressure to meet deadlines.
Commitment to maintaining high standards of professional ethics and confidentiality.
Strong understanding and organisation of financial matters.
