About the Role

The Associate's primary focus will be Aboriginal law, including Aboriginal and Treaty Rights, consultation and accommodation, reserve and Aboriginal title lands, and Indigenous self-determination and jurisdiction. The role may also involve regulatory proceedings and public law litigation such as constitutional, administrative, and municipal law matters.

Responsibilities

• Assist in the conduct of major litigation files and assume carriage of small to mid-size litigation and negotiation files.
• Develop and execute legal and litigation strategies.
• Conduct research.
• Draft correspondence, affidavits, pleadings, and applications.
• Draft legislation for Indigenous governments and implement or coordinate agreements with governments.
• Interview witnesses, prepare evidence, and prepare for discovery.
• Perform oral advocacy, including speaking to applications and portions of oral submissions.
• Facilitate community sessions on law-making, Elders, and knowledge keeper deliberations regarding Indigenous teachings and knowledge systems for law-making.
• Prepare for trials, including preparing questions and statements, and attend all levels of Court.
• Assist counsel with negotiations, including self-government, jurisdictional, and exploratory discussions related to clients’ exercise of jurisdiction and self-determination.
• Assist with the management of files on behalf of clients.
• Attend all levels of court.

Requirements

• Over 8+ years of litigation experience.
• Experience in the Quebec Superior Court and the Federal Court.
• Strong skills in advocacy and oral and written communication.
• Excellent analytical, interpretive, research, and drafting skills.
• Proven negotiation skills.
• Ability to work independently.
• Familiarity with civil procedures.
• Proficiency in building relationships and working well in a team environment.
• Eligibility to practice law in Ontario as a member in good standing with the Law Society of Ontario.
• Experience working for Indigenous communities or individuals (asset).
• Experience with Aboriginal and Constitutional Law (asset).
• Experience and knowledge of the regulatory hearing processes (asset).
• Familiarity with negotiation and consultation processes involving Indigenous Nations, government, and industry (asset).
