About the Role

Axsome Therapeutics is seeking a Director, Intellectual Property to build the company's intellectual property portfolio and contribute to its patent and trademark strategies. This role involves evaluating discoveries, managing filings to patent issuance, and supporting R&D efforts with a strong understanding of U.S. and foreign patent systems.

Responsibilities

• Manage prosecution of patents and trademarks in the U.S. and globally, including patent term extensions and SPCs, working closely with external counsel.
• Provide legal support for negotiating, drafting, and reviewing licensing, co-promotion, co-development, co-marketing, and clinical trial collaboration agreements.
• Monitor R&D results, new uses, and formulations, managing disclosures and publications to ensure timely patent protection.
• Manage patent term extensions, Orange Book listings, and regulatory exclusivity claims for pipeline and marketed products.
• Conduct freedom-to-operate, patentability, and infringement/validity analyses.
• Monitor legal developments and update the Executive Leadership Team.
• Recommend strategic policies and procedures to maximize IP protection.
• Develop IP policy, procedure, and training on IP law and topics.

Requirements

• 5+ years of relevant experience.
• JD with admission to practice in at least one state bar.
• Scientific degree relevant to the life sciences industry.
• Registration to practice before the USPTO.
• Ability to work on-site Monday, Tuesday & Thursday.

Skills

• Evaluating and identifying new discoveries.
• Leading patent filings from initial applications to worldwide issuance.
• Supporting R&D efforts.
• Strong understanding of U.S. and foreign patent systems.
• Patent filing and prosecution processes.
• Supporting small-molecule pharmaceutical or biotechnology products.
• Developing small-molecule patent strategy.
• Drafting patent applications (composition-of-matter, formulations, polymorphs, salts, dosing regimens, method-of-treatments) is a plus.
• Prior law firm and in-house experience at pharmaceutical and/or biotechnology company is a plus.
• Comfort working on cross-functional projects with scientific, clinical, and regulatory colleagues.
• Strong communications skills.
