About the Role

The Litigation Attorney III position is within the General Litigation Team of the Legal Services Division. This role provides legal advice and support for pending or threatened litigation against HHS or its employees. The department serves as the primary contact with the Office of the Attorney General for prosecuting and defending lawsuits and administrative actions.

Responsibilities

  • Performs complex legal work including legal research, interpreting state and federal laws, drafting legal documents and memoranda, responding to subpoenas, and providing legal advice.
  • Manages litigation and coordinates with the Office of the Attorney General to defend and prosecute lawsuits, including discovery, motion practice, attending hearings, and preparing for trial.
  • Drafts summaries of new litigation, evaluates potential risks, and develops litigation strategy.
  • Drafts timely and accurate updates on litigation status and developments for management.
  • Researches legal issues and provides analysis and advice.
  • Drafts letters to the Office of the Attorney General requesting representation.
  • Works with assigned Assistant Attorney General and agency staff to respond to complaints and petitions.
  • Researches claims and defenses and ensures appropriate motions are filed.
  • Drafts, reviews, and edits briefs and motions.
  • Reviews discovery requests and works with agency staff to identify responsive information and documents.
  • Drafts, reviews, and edits discovery responses and objections.
  • Uses e-discovery software to review documents for production.
  • Drafts and reviews discovery requests.
  • Ensures the Office of the Attorney General pursues offensive discovery as needed.
  • Reviews settlement recommendations from the Office of the Attorney General and drafts settlement recommendations.
  • Participates in settlement negotiations and ensures settlement documents protect agency interests.
  • Works with the Office of the Attorney General and agency staff to ensure compliance with court orders.
  • Drafts recommendations on whether to appeal court rulings.
  • Drafts, reviews, and edits appellate briefs and arguments.
  • Works with the Office of the Attorney General to ensure appeals are filed timely.
  • Attends work on a regular and predictable schedule.
  • Performs other duties as assigned.

Requirements

  • Must be licensed as an attorney by the State of Texas and a member in good standing with the State Bar of Texas.
  • Must have graduated from an accredited law school with a Bachelor of Laws (LLB) or a Juris Doctor (JD) degree.
  • Must have at least three years of experience in litigation.
